“I Thought I Would Qualify for Legal Aid”


 

One of the most common questions we hear at FLAG DV is:

“Can I get legal aid?”

Unfortunately, there is rarely a simple yes or no answer.

Many survivors of domestic abuse assume that legal aid will automatically be available because they have experienced abuse. Others assume they will not qualify because they own a home or have a job. The reality is often much more complicated.

Over the years, we have seen many survivors become frustrated and confused when trying to understand how legal aid works. Some discover they are not eligible when they expected to be. Others are eligible but struggle to find a solicitor able to take on their case.

Some of the most common misconceptions we encounter include:

  • “I’ve experienced domestic abuse, so I automatically qualify for legal aid.”
  • “I need a criminal conviction against the perpetrator.”
  • “If I qualify for legal aid, a solicitor will automatically be provided.”
  • “Legal aid covers all aspects of a separation.”
  • “If I can’t get legal aid, I have no options.”

In practice, legal aid can depend on a number of factors, including the type of legal issue, financial circumstances, available evidence and whether a solicitor is available to take on the case.

Many survivors are also surprised to learn that qualifying for legal aid and finding a legal aid solicitor are two separate challenges.
